DUI Convictions Can Carry Steep Penalties:

In any DUI case one of our main goals is avoiding a DUI conviction. Even a first-time DUI conviction can carry difficult probation conditions or even jail time, in addition to increasing your insurance rates and impacting your ability to drive.

Florida has the following levels of penalties for DUI convictions:

Penalties for First-Time DUI (Under .15 BAC):

The penalties for a first-time DUI conviction with a breath result under 0.15 can include the following:

  • A fine of $500.00 to $1,000.00.
  • Up to 6 months in jail.
  • 50 hours of community service.
  • Up to 1 year of probation.
  • A driver’s licence revocation of 180 days up to a maximum of a full year.
  • Level 1 DUI School.
  • 10 day vehicle impoundment.

Realistically, very few first-time DUI convictions result in jail time. Usually a first-time conviction results in 12 months of probation instead of jail.

Penalties for First-Time DUI (Above .15 BAC):

The penalties for a first-time DUI conviction with a breath result above 0.15 can include the following:

  • A fine of $1,000.00 to $2,000.00.
  • Up to 9 months in jail.
  • 50 hours of community service.
  • Up to 1 year of probation.
  • A driver’s licence revocation of 180 days up to a maximum of a full year.
  • Level 1 DUI School.
  • Placement of an ignition interlock on your vehicle for a minimum of 6 months.
  • 10 day vehicle impoundment.

Penalties for Second-Time DUI (Under .15 BAC):

The penalties for a second-time DUI conviction with a breath result under 0.15 include the following:

  • A fine of $1,000.00 to $2,000.00.
  • Up to 9 months in jail.
    • Note: for a second-time DUI conviction within 5 years the court must impose a 10-day jail sentence.
  • Up to 1 year of probation.
  • A driver’s licence revocation of 180 days up to a maximum of a full year.
    • Note: for a second-time conviction within 5 years the mandatory license revocation is five years.
  • Level 2 DUI School.
  • Placement of an ignition interlock on your vehicle for a minimum of 1 year.
  • For a second DUI conviction within 5 years a 30 day vehicle impoundment.

Penalties for Second-Time DUI (Above .15 BAC):

The penalties for a second-time DUI conviction with a breath result under 0.15 include the following:

  • A fine of $2,000.00 to $4,000.00.
  • Up to 12 months in jail.
    • Note: for a second-time DUI conviction within 5 years the court must impose a 10-day jail sentence.
  • Up to 1 year of probation.
  • A driver’s licence revocation of 180 days up to a maximum of a full year.
    • Note: for a second-time conviction within 5 years the mandatory license revocation is five years.
  • Level 2 DUI School.
  • Placement of an ignition interlock on your vehicle for a minimum of 1 year.
  • For a second DUI conviction within 5 years a 30 day vehicle impoundment.

Penalties for Third-Time DUI Within 10 Years:

The penalties for a third-time DUI conviction within 10 years of a prior DUI conviction include the following:

  • Any third-time DUI conviction within 10 years of the last DUI conviction is a felony.
  • A fine of up to $5,000.00.
  • Up to 5 years in prison.
    • Note: for a third-time DUI conviction within 10 years the court must impose a 30-day jail sentence.
  • 90 day vehicle impoundment.
  • A driver’s licence revocation of 10 years.
    • Note: A hardship permit is available after 2 years.
  • Level 3 DUI School.
  • Placement of an ignition interlock on your vehicle for a minimum of 2 years.
